By proceeding, you are legally agreeing to all of the terms outlined below.

The personal information you provide to us through our services or otherwise includes:

Contact Data: Personal or business contact information such as your first and last name, email and mailing addresses, phone number, professional title, and company name.
Registration Data: Information you provide to register for an account or sign up for an event.
Data About Others: Information for whom you purchase an item or gift, such as name, delivery address, and phone number. Please ensure you have their permission before sharing this information with us.
Profile Data: Your username, password, interests, and preferences to establish an online account.
Communications: Information provided when you contact us with questions, feedback, or survey responses.
Marketing Data: Contact details used for marketing communications and your preferences for receiving updates about events and promotions.
Purchase Data: Your order history and information needed to fulfill your order, including billing and delivery addresses.
Data Sharing & Usage: We do not sell your personal information. We only share data with trusted third-party payment processors or platforms strictly necessary to fulfill your services and process transactions securely.

Payments & Invoicing

A 50% initial deposit is due upfront to begin your project. The remaining 50% is due after your designs have been completed and approved. All payments will be requested via bank-to-bank transfer only. We do not accept PayPal for custom design services to protect against fraudulent disputes regarding intangible digital goods. Failure to remit the final payment after work completion may result in legal action.

Contracts

Before any project begins, BrandingByJ requires a legally binding business contract to be signed by both parties.

Refunds

We do not issue refunds under any circumstances. Because our services require weeks of dedicated design time and labor, the 50% initial deposit is strictly non-refundable. Once work has commenced, all payments made are final. We are highly committed to customer satisfaction and will work diligently to ensure you are happy with the final product.

Revisions

Projects include up to 3 rounds of standard revisions to ensure the design aligns with your vision. Any additional revisions requested beyond this allowance will be billed at our standard hourly rate.

Client Communication & Project Abandonment

Timely communication is essential for keeping projects on track. If a client becomes unresponsive to emails or project inquiries for more than 30 consecutive days, the project will be considered abandoned. In this event, the contract will be terminated, and a restart fee will be required to resume any work.

Ownership & Portfolio Rights

Upon final payment, you receive full ownership of your finalized designs and may use, remake, redesign, or adjust them as needed. BrandingByJ retains a copy of all submitted photography, logos, and completed designs, reserving the right to display them for promotional purposes on any platform of our choice (including our website, Instagram, marketing emails, etc.).

Time Frame Policy

All project timelines provided are estimates. Completion dates depend heavily on client response times and the number of revisions requested. Please allow a grace period of 2 to 7 business days beyond the initially predicted completion date. If a delay occurs on our end, we may offer complimentary work as compensation, at our discretion.

Right to Resell Unused Concepts

If you are unhappy with a design concept (such as a logo or website layout) and request a completely new direction, we reserve the right to resell the original, unwanted design. Any names or pictures unique to your brand will be removed, but the general concept and layout may be resold.

Under no circumstances may any designs, concepts, business names, or branding displayed on our website be copied or reproduced. By browsing our website, you legally agree not to copy any of our intellectual property. Any unauthorized reproduction will result in immediate legal action, including the pursuit of statutory damages and attorney’s fees.

Governing Law & Jurisdiction

These terms and agreements are governed by the laws of the State of Florida. Any legal disputes, claims, or breach of contract issues will be handled exclusively in the courts located in Miami, Florida.
